ICTJ opposes pardons appeal to South Africa's Constitutional Court
The Pretoria High Court decided on April 29 to block the South African
President from issuing pardons under a special process for political
crimes pending the final determination of the case.
ICTJ is a member of a coalition of South African civil society organizations challenging the exclusion of victims from this process. The coalition has argued that this secretive process is unconstitutional and that it violated the spirit and legacy of South Africa's Truth and Reconciliation Commission, which included victims in public hearings before offering amnesty to perpetrators.
The legal challenge has already succeeded in preventing former President Kgalema Motlanthe from granting pardons in advance of national and provincial elections. ICTJ has filed substantive papers opposing
the appeal to the Constitutional
Court, South Africa’s highest court. These and other legal filings are available, as well as a selection of news stories about the case.
